On December 28, 2018, Jiangsu Province High People's Court (hereinafter referred to as "Jiangsu High Court") sentenced Shanxi Xiangyu Chemical Co., Ltd (hereinafter referred to as "Shanxi Xiangyu") and three natural persons' violation of Sennics Co., Ltd. (hereinafter referred to as "Sennics") trade secrets. Shanxi Xiangyu was fined RMB20 million, recovered illegal proceeds and confiscated the tools and drawings, and three natural persons were sentenced to corresponding punishments and fines accordingly. So far, a sustained and highly concerned infringement of intellectual property rights in the industry was settled.

The court ruled that since 2007, Shanxi Xiangyu has illegally stolen technical data such as production processes and equipment drawings of Sennics' RT Base and Antioxidant 4020, and used them in the equipment reconstruction of its old plant and the construction of its new plant production equipment. In 2012, the RT Base and Antioxidant4020 production unit of Shanxi Xiangyu was completed and put into operation. The above acts of Shanxi Xiangyu seriously violated the national laws and regulations, disrupted the normal order of market economy, and caused great economic losses to Sennics.

The final decision of Jiangsu High Court not only effectively maintains the industry order and the legitimate rights and interests of Sennics as the intellectual property rights holder, but also highlights the firm position and determination of the state to strengthen the judicial protection of intellectual property rights.
