On November 15th, 2021, the Higher People's Court of Jiangsu Province (the "Court") made the first-instance judgment on the technical secrets infringement disputes between the plaintiff Sennics Co., Ltd. ("Sennics") and the defendants Chen Yonggang, the ex-legal representative of Shanxi Xiangyu Chemical Co., Ltd. ("Shanxi Xiangyu"), and Yuncheng Jinteng Chemical Technology Co., Ltd. ("Yuncheng Jinteng", co-infringer under the actual control of Chen Yonggang), and sentenced that Chen Yonggang and Yuncheng Jinteng shall immediately cease the infringing acts against the trade secrets of Sennics, destroy, within fifteen days upon the effectiveness of the judgment, the production facility manufactured with the trade secrets of Sennics, and compensate Sennics for a loss of RMB 201.54 million as well as a reasonable expense for stopping the infringing acts in the amount of RMB 469,542.
On December 28th, 2018, the Court made the final judgment on the trade secrets infringement criminal case, finding that Shanxi Xiangyu and three individuals had committed the crime of infringing the trade secrets of Sennics, and imposed criminal punishment accordingly. During the trial of the criminal case and after the effectiveness of the criminal judgment, Shanxi Xiangyu and its co-infringers have not ceased infringing acts. On April 29th, 2019, based on the effective criminal judgment, Sennics filed the relevant civil case at the Court.
The judgment of the Court has not only safeguarded the legitimate rights and interests of Sennics as the owner of the intellectual property rights, maintained the industry order, but also demonstrated the firm stand and determination of our country to strengthen the judicial protection of the intellectual property rights.
